Comments: Brigantine Joseph (Emperor Moseley), was an American vessel, sailing for Hewes and Smith of North Carolina, and bound from Cadiz, Spain to North Carolina. She was captured a few days from port in North Carolina by the Massachusetts Privateer Schooner Eagle (Commander Barzilla Smith) in November 1776. When captured by the Eagle, Moseley could not convince the captors he was American, and Joseph was sent into Boston. En route the Joseph was captured by HM Sloop Merlin on 26 November 1776, and taken into New York. North Carolina lodged a complaint with the Continental Congress, which ordered, on 4 June 1777, that Massachusetts investigate the matter, make restitution, and punish the offenders. On 13 September 1777 the Continental authorities signed their interest in Eagle’s bond over to Hewes and Smith to allow prosecution of the owners and master.
