New Hampshire Privateer Brigantine Fair American was commissioned on 1 September 1781 under Commander Hugh Chichester1 (or Chisholm)2 of Kittery, Massachusetts [Maine]. She was described as a brig, with her battery listed as eight guns and her crew as thirty-five men. Her $20000 bond was signed by Chichester and by John Langdon and Reuben Shaplay, both of Portsmouth.3
About mid-September 1781 Fair American was on her first voyage, when she was captured by HM Sloop Vulture (Commander Walter Griffith) and HM Frigate Assurance (Captain William Swiney).4 She was taken into Halifax, Nova Scotia and libeled there on 4 October 1781.5
